4. Booking Terms and Payment
4.1 Booking Process
All bookings made through irishsferries.org are subject to availability. A booking is not confirmed until you receive a written confirmation from us via email. We reserve the right to decline or cancel any booking at our absolute discretion, in which case we will issue a full refund of any payments received for that booking.
It is your responsibility to ensure that all details provided at the time of booking, including names, travel dates, vehicle information, and passenger numbers, are accurate and complete. Errors in booking details may result in additional charges or the inability to travel.
4.2 Pricing and Fares
All prices displayed on the Website are quoted in Euro (€) and include applicable Value Added Tax (VAT) unless otherwise stated. Prices are subject to change without notice and are only guaranteed at the time of confirmed payment. Please note, however, that the 14-day cooling-off period may not apply to ferry tickets and transport services where specific travel dates and times have been confirmed, as per the exceptions outlined under EU and Irish consumer law. Specific cancellation and refund policies applicable to individual bookings will be communicated at the time of booking and in your booking confirmation.
Any amendments to bookings, including changes to dates, routes, passenger names, or vehicle details, may be subject to an amendment fee and any applicable fare difference. Requests for amendments should be made by contacting us at [email protected].
5. Intellectual Property Rights
All content published on or made available through the Website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the overall design, layout, and look-and-feel of the Website (collectively, the "Content"), is the exclusive intellectual property of the Company or its licensors and is protected under the Copyright and Related Rights Act 2000 (Ireland), as amended, and applicable European Union intellectual property laws and international treaties.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and its Content solely for your personal, non-commercial use in connection with booking and using our Services. This licence does not permit you to:
- Reproduce, copy, distribute, or republish any Content without our prior written consent;
- Modify, adapt, translate, or create derivative works based on the Content;
- Use the Content for any commercial purpose or for any public display;
- Remove or alter any proprietary notices, labels, or marks on the Content.
Any trademarks, service marks, trade names, logos, and brand identifiers displayed on the Website are the property of the Company or their respective owners. Nothing in these Terms grants you any licence or right to use any such marks without the express written permission of the relevant owner.
If you believe that any Content on the Website infringes your intellectual property rights, please notify us in writing at [email protected] with full details of your claim.
6. Disclaimer of Warranties
The Website and all Services are provided on an "as is" and "as available" basis, without any warranties or representations of any kind, either express or implied, to the fullest extent permitted by applicable Irish and European Union law.
We expressly disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Warranties that the Website will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
- Warranties regarding the accuracy, completeness, reliability, timeliness, or suitability of any content or information published on the Website;
- Warranties that any defects or errors will be corrected.
We do not warrant that the Website will meet your specific requirements or that any information obtained through the Website is accurate, current, or complete. Travel schedules, fares, and availability are subject to change without notice. You acknowledge that reliance on any information provided on the Website is at your own risk.
Nothing in this section shall limit or exclude any statutory warranties or rights which cannot be excluded under applicable Irish or European Union consumer protection law, including those provided under the Sale of Goods and Supply of Services Act 1980 (Ireland) and the Consumer Rights Act 2022 (Ireland).
7. Limitation of Liability
To the maximum extent permitted by applicable Irish and European Union law, the Company, its directors, officers, employees, agents, affiliates, licensors, and service providers shall not be liable for any:
- Indirect, incidental, special, consequential, punitive, or exemplary damages;
- Loss of profits, revenue, data, goodwill, or business opportunities;

In any event, our total aggregate liability to you for all claims arising out of or in connection with these Terms, the Website, or the Services shall not exceed the total amount paid by you to us in the 12 months immediately preceding the event giving rise to the claim, or €100, whichever is greater.
These limitations apply regardless of the form of action, whether based in contract, tort (including negligence), strict liability, or any other legal theory, and regardless of whether we have been advised of the possibility of such damages.
Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded or limited under applicable Irish or European Union law, including the Liability for Defective Products Act 1991 (Ireland).
8. Third-Party Links and Services
The Website may contain links to third-party websites, applications, or services that are not owned or controlled by us. These links are provided for your convenience and information only. We have no control over the content, privacy practices, or policies of any third-party websites and accept no responsibility or liability for them.
The inclusion of any link on the Website does not imply our endorsement of the linked website or any association with its operators. You access third-party websites entirely at your own risk and subject to the terms and conditions of those websites.
Where we act as an intermediary or agent for third-party service providers, including ferry operators, their specific terms and conditions will apply to the relevant booking, in addition to these Terms.
9. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its directors, officers, employees, agents, affiliates, contractors, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and disbursements) arising out of or relating to:
- Your use of or inability to use the Website or Services;
- Your breach of these Terms or any applicable law or regulation;
- Your violation of any third-party rights, including intellectual property rights, privacy rights, or contractual rights;
- Any fraudulent, negligent, or wilful misconduct on your part;
- Any content or information submitted, posted, or transmitted by you through the Website;
- Your failure to ensure that passengers in your booking comply with applicable travel requirements and documentation rules.
We reserve the right to assume exclusive control of the defence of any matter otherwise subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defences at your own expense.
10. Data Protection and Privacy
We are committed to protecting your personal data in accordance with the General Data Protection Regulation (EU) 2016/679 ("GDPR"), the Data Protection Acts 1988–2018 (Ireland), and all other applicable Irish and European Union data protection legislation. The Data Protection Commission (DPC) is the relevant supervisory authority in Ireland.
Your use of the Website and Services involves the collection and processing of personal data as described in our Privacy Policy, which is available on the Website and incorporated into these Terms by reference. By using our Services, you acknowledge that you have read and understood our Privacy Policy.
If you have any queries or concerns about how we process your personal data, or wish to exercise any of your rights under applicable data protection law, please contact us at [email protected].
11. Governing Law and Jurisdiction
These Terms and any dispute, controversy, or claim arising out of or in connection with them, or their formation, validity, enforceability, or termination (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law provisions.
Subject to Section 12 below, you irrevocably submit to the exclusive jurisdiction of the courts of Ireland to settle any dispute or claim arising out of or in connection with these Terms or the Website or Services. Nothing in this clause shall limit our right to take proceedings against you in any other court of competent jurisdiction, nor shall the taking of proceedings in any one or more jurisdictions preclude the taking of proceedings in any other jurisdictions, whether concurrently or not, to the extent permitted by applicable law.
If you are a consumer resident within the European Union, you may also benefit from any mandatory consumer protection provisions afforded by the laws of your country of residence, and nothing in these Terms shall operate to deprive you of those protections.
EU consumers may also use the European Commission's Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr, to seek resolution of disputes arising from online transactions.
12. Dispute Resolution
12.1 Informal Resolution
In the event of any dispute, disagreement, or claim arising from or relating to these Terms, the Website, or the Services, we encourage you to contact us in the first instance to attempt to resolve the matter informally. Please write to us at [email protected] with a detailed description of your complaint or concern, and we will endeavour to respond promptly and work with you to reach a satisfactory resolution within 30 days of receiving your notice.
12.2 Alternative Dispute Resolution
If we are unable to resolve a dispute informally within the timeframe set out above, either party may seek recourse through alternative dispute resolution (ADR) mechanisms. We are committed to engaging in good faith with ADR procedures where required by applicable Irish or European Union consumer protection law.
Consumer disputes may also be referred to the Competition and Consumer Protection Commission (CCPC) in Ireland or to an approved ADR body under the European Union (Alternative Dispute Resolution for Consumer Disputes) Regulations 2015, which implement EU Directive 2013/11/EU on ADR for consumer disputes.
12.3 Litigation
If a dispute cannot be resolved through informal negotiation or ADR, either party may pursue their rights through the Irish court system as outlined in Section 11 above.
13. Term and Termination
These Terms shall remain in full force and effect for as long as you continue to access or use the Website or Services. We may, at our sole discretion and without notice or liability, suspend or terminate your access to the Website and Services for any reason, including but not limited to:
- A breach by you of these Terms or any applicable law;
- Fraudulent, abusive, or otherwise unlawful conduct;
- Failure to pay for Services properly rendered;
- Extended periods of account inactivity;
- Cessation of the Website or Services, in whole or in part.
You may terminate your use of the Website and Services at any time by ceasing to access the Website and, if applicable, by closing your registered account. Termination of your account shall not affect any rights or obligations that arose prior to termination, including any confirmed bookings, outstanding payments, or applicable cancellation policies.
Upon termination for any reason, the following provisions of these Terms shall survive: Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, Dispute Resolution, and this Termination clause.
14. Changes to These Terms
We reserve the right to amend, modify, or replace these Terms at any time at our sole discretion. Any changes will take effect immediately upon publication of the revised Terms on the Website, unless we specify a later effective date. The date of the most recent update will be indicated at the top of this page.
We will endeavour to notify registered users of any material changes to these Terms by email or through a prominent notice on the Website prior to the changes taking effect. However, it is your responsibility to review these Terms periodically to stay informed of any updates.
Your continued use of the Website or Services following the publication of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must cease using the Website and Services immediately and, where applicable, cancel any outstanding bookings in accordance with our cancellation policy.
15. Force Majeure
We shall not be liable for any failure or delay in the performance of our obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, floods, fire, earthquakes, storms, extreme weather conditions, pandemic or epidemic events, war, terrorism, civil unrest, government actions or restrictions, strikes or industrial action, port closures, maritime disruptions, fuel shortages, or failure of third-party infrastructure or services ("Force Majeure Event").
In the event of a Force Majeure Event, we will notify you as soon as reasonably practicable and will use reasonable endeavours to minimise the impact on your booking and travel arrangements. We will work with you to explore alternative solutions, including rebooking or, where possible and applicable, issuing a refund, subject to the terms of any relevant ferry operator and applicable law.
16. Severability
If any provision, clause, or part of these Terms is found by a court of competent jurisdiction or any other competent authority to be invalid, unlawful, void, unenforceable, or contrary to any applicable law or regulation, such provision shall be deemed severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect to the maximum extent permitted by law, and shall not be affected or impaired by such severance.
In the event that any provision is severed, the parties agree that the court or authority shall, to the extent permissible under applicable law, give effect to the intentions of the parties as reflected in the original provision, and shall substitute a valid, enforceable provision that most closely reflects the original intent and commercial purpose of the severed provision.
17. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and any other policies or notices published on the Website, constitute the entire agreement between you and the Company with respect to your use of the Website and Services, and supersede all prior and contemporaneous agreements, representations, warranties, negotiations, and understandings, whether oral or written, between the parties relating to the subject matter hereof.
No failure or delay by either party in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy, nor shall any single or partial exercise of any right, power, or remedy preclude any other or further exercise thereof or the exercise of any other right, power, or remedy.
18. Assignment
You may not assign, transfer, sub-licence, or delegate any of your rights or obligations under these Terms to any third party without our prior written consent. We may freely assign or transfer our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganisation, sale of assets, or by operation of law. Any purported assignment in violation of this section shall be null and void.
19. Accessibility
We are committed to making our Website accessible to all users, including those with disabilities, in accordance with applicable Irish and European Union accessibility requirements. If you experience any difficulties accessing the Website or any of its content, please contact us at [email protected] and we will endeavour to assist you.
20. Consumer Rights
If you are a consumer (as defined under Irish and EU consumer protection law), these Terms do not affect your statutory rights under applicable legislation, including but not limited to:
- The Consumer Rights Act 2022 (Ireland);
- The Sale of Goods and Supply of Services Act 1980 (Ireland);
- The European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013;

- The Competition and Consumer Protection Act 2014 (Ireland);
- Regulation (EC) No 1177/2010 concerning the rights of passengers when travelling by sea and inland waterway.
In the event of any conflict between these Terms and your statutory consumer rights under applicable Irish or European Union law, your statutory rights shall prevail.
